AI Act Article 50 on 2 August 2026: what creators using AI for Reels and posts need to set up now
On 2 August 2026 AI Act Article 50 enters into force: AI-generated or AI-manipulated content must be marked machine-readable, and creators must visibly disclose deepfakes and AI-generated text. What exactly does AI Act Article 50 say?
Short answer: Four obligations for "deployers" and "providers" of AI systems that produce output — focused on transparency toward end users. The article entered into force on 1 August 2024 and becomes enforceable on 2 August 2026 (24 months grace).
The four core rules of Article 50, summarised:
- AI chatbot disclosure (paragraph 1): If you or your tool deploys an AI system that interacts with natural persons, the user must know at first contact that they are talking to AI — unless this is already obvious.
- Synthetic content marking (paragraph 2): Providers of AI systems that generate or manipulate image, audio, video or text must mark the output machine-readable as "artificially generated or manipulated". Methods must be effective, interoperable, robust and reliable — think watermarks, metadata, cryptographic methods or fingerprinting.
- Deepfake disclosure (paragraph 4, first sub-paragraph): Deployers of an AI system that produces a deepfake must visibly disclose that the content is artificially generated or manipulated. For artistic, satirical or fictional work the disclosure may be less prominent but must still be present.
- AI text on public interest (paragraph 4, second sub-paragraph): Text generated or manipulated by AI and published to inform the public on matters of public interest must be marked as such — unless a human reviews the content and takes editorial responsibility.
The deadline of 2 August 2026 is firm. Fines under the AI Act run up to €15 million or 3% of worldwide turnover for non-compliance with transparency obligations (Article 99(4)).
Definitions: which terms must you know?
Short answer: Five terms from the AI Act that directly determine whether your post falls under Article 50. Below each definition in one sentence, with source.
- AI-generated or manipulated content
- In one sentence: Output from an AI system that creates or significantly modifies image, audio, video or text — even if the starting point was human work.

Which creator content falls under Article 50?
Short answer: Almost every Reel, post or video where a creator used AI for image, voice, subtitles, dance overlays or voice-overs falls under paragraph 2. Anyone using deepfakes (making a family member "speak", parodying a politician, animating a brand mascot) also falls under paragraph 4.
Concretely — what touches your workflow:
- AI-generated Reels (Sora, Runway, Higgsfield Seedance, Veo): Provider already supplies an embedded watermark; you must add the visible disclosure if it's a deepfake.
- AI voices (ElevenLabs voice clone, OpenAI TTS): Audio output is "AI-generated" — visible disclosure if the voice resembles a real person.
- AI thumbnails (Midjourney, Nano Banana, ChatGPT-image): Synthetic image — counts as AI output; portraits of existing persons = deepfake.
- AI captions (GPT-4o, Claude, Gemini): Text doesn't always need disclosure (paragraph 4 sub 2 has "public interest" as trigger), but publications on news, health, legal tips do unless you review editorially.
- AI editing of existing footage (Adobe Firefly object removal, AI upscaling, gen-fill): "Manipulated content" falls under paragraph 2 — machine-readable marking is provider-side; visible disclosure only if the manipulation reaches deepfake level.
Pure tools support (auto-cut in DaVinci, AI volume levelling, background blur) falls outside the definition — those don't "significantly" generate or manipulate content.
How does machine-readable marking work technically?
Short answer: Providers (Sora, Higgsfield, ElevenLabs) embed an invisible watermark or cryptographic signature into the output. Standard is C2PA (Coalition for Content Provenance and Authenticity), which attaches metadata to PNG/JPG/MP4 and tracks which model produced the output.
For creators this means: stay within tools that support C2PA or comparable provenance marking. As of 9 May 2026 that includes OpenAI Sora, Adobe Firefly, Microsoft Copilot, Google Gemini, Higgsfield Nano Banana 2 and Higgsfield Seedance. Tools without C2PA support (some open-source forks, old pre-2024 models) put you in provider-side non-compliance — avoid them.
Important: machine-readable marking is the provider's obligation. As deployer you don't need to check this yourself — but make sure your upload tool doesn't strip the metadata. TikTok, Instagram and YouTube preserve C2PA metadata since April 2026; X/Twitter and Bluesky vary.

Step 1 — Audit your AI tools (5 min)
List every AI tool you use for content. Per tool: does it support C2PA or comparable provenance marking? Tools that do NOT support before August → replace or keep out of public-facing production.

Short answer: Meta, TikTok and YouTube have had their own AI labelling (self-declare + auto-detect via C2PA metadata) since 2024. The AI Act adds a European-legal layer: not platform-discretionary, but enforceable by national supervisors with fines up to €15M.
Practical difference: platform labels can be changed or disappear with UI updates; AI Act disclosure is your own responsibility and must be present regardless of whether the platform shows it. That's why an own bio-link with /ai-policy page is a better anchor than relying on TikTok's "AI-generated" badge.
What exceptions are there?
Short answer: Three explicit exceptions in Article 50 — but read them narrowly, because creators often interpret them too broadly.
- Artistic, creative, satirical or fictional works (paragraph 4 sub 3): The disclosure may be less prominent, but must still be present and the user may not be misled about the nature of the work.
- Legally permitted criminal investigation (paragraphs 2 + 4): Does not apply to creators — only to authorised law enforcement.
- Text disclosure not required (paragraph 4 sub 2): When a human exercises editorial control AND takes responsibility. A blog publication where you or an editor checks and edits every AI-written paragraph falls under this; pure auto-publish AI feeds do NOT.
"It was funny" or "everyone knows it's AI" are not exceptions under Article 50.

Frequently asked questions
Does AI Act Article 50 also apply to creators outside the EU?
Short answer: Yes, if your content targets or is accessible to EU users. The AI Act has extraterritorial reach (Article 2). A US creator whose TikTok shows in NL/DE/FR is in scope for that audience.
What if I just slap "made with AI" as a hashtag — enough?
Short answer: For pure AI content without deepfake element often yes, provided it's visible. For deepfakes (resembles real person/place/event) the disclosure must be more prominent — preferably as overlay text in the first seconds or pinned comment, not just hashtag-30 in a long caption.
Do AI subtitles (Whisper, AI translate) count as content that must be marked?
Short answer: The text disclosure requirement (paragraph 4 sub 2) applies only to publications on matters of public interest. An AI-translated travel-vlog subtitle is out of scope; AI-translated news or health subtitles are in scope.
Who is the Dutch supervisor?
Short answer: The Dutch Data Protection Authority (Autoriteit Persoonsgegevens, AP) gets the national role as AI supervisor for the Netherlands; co-execution by RDI and ACM for specific domains. Fines under Article 99 are handled via the AP.
